Federal Agencies Soliciting Comments on Environmental Justice Plans

Regulatory "Train Wreck" Updates
November 29, 2011The Environmental Protection Agency will develop and finalize multiple rules over the next several years that will dramatically impact the air, water, and energy regulatory climate. This unprecedented level of activity will be mirrored at the state level since each federal regulation will trigger the promulgation of state rules to implement the standards. Studies have shown these rules will have an impact on the overall economy, jobs, competitiveness, and energy costs.
Below is a brief summary of of the most recent action on the multitude of rules under promulgation as well as information on expected future actions.
EPA to Develop Reporting Rule for Fracking Chemicals
November 28, 2011The Environmental Protection Agency will partially grant the Aug. 4, 2011 petition of Earthjustice and 120 other groups, requesting that EPA issue Toxic Substances Control Act (TSCA) section 4 and 8 rules requiring toxicity testing and reporting of health and safety studies on oil and gas exploration and production chemicals. On Nov. 23rd the EPA announced it will partially grant the reporting portion of the petition, and will solicit public input on the design and scope of possible reporting requirements for chemicals used in hydraulic fracturing.
Sensenbrenner Seeks to Delay E15
November 22, 2011Wisconsin Congressman Jim Sensenbrenner is leading a two front attack on the EPA’s registration of E15 fuel. Sensenbrenner has introduced legislation requiring more studies and higher standards and has also asked the EPA to delay any action on E15.
EPA Rules Generate Electric Reliability Concerns
November 21, 2011The EPA’s new regulations impacting power plants have many questioning the overall impact the rules will have on the nation’s electric reliability. An upcoming technical conference hosted by the Federal Energy Regulatory Commission (FERC) will provide greater insight on the potential impacts of the impending EPA regulations. A recent article in the Milwaukee Journal-Sentinel highlighted one possible impact in Wisconsin and Michigan.
Obama Administration “Can’t Wait” to introduce New Fuel Economy and GHG Pollution Standards
November 17, 2011Today, November 17, 2011, The Environmental Protection Agency (EPA) and the Department of Energy (DOE) formally unveiled their joint proposal to set stronger fuel economy and greenhouse gas pollution standards. This plan for strengthening Corporate Average Fuel Economy standards, is known as CAFE, and is in effect for model years 2017-2025. The 2025 target is 54.5 miles per gallon (mpg), which is almost double the current standard.
States, Congress, and Coast Guard All Working on Ballast Water Discharge Standards
November 16, 2011The U.S. House of Representatives approved a bill Tuesday that would set national standards for cleansing ship ballast water and prohibit states from setting stronger standards in an effort to slow the advancement of invasive species. The law would adopt the International Maritime Organization's standard, which requires ocean-going ships to install technology to limit the number of live organisms in their ballast water.
EPA Administrator Jackson Speaks at the UW
November 15, 2011Around 400 people attended an event on the UW campus featuring EPA Administrator Lisa Jackson on Tuesday, November 15th. Jackson mentioned the EPA “train wreck” and some of the rules that are a part of it, calling Congressional attempts to interfere with the EPA’s work “too dirty to fail.” Jackson’s full remarks are available here.
EPA Announces Schedule for Regional Haze Rule Implementation

Senate Defeats Effort to Void CSAPR
